THE COUNCIL,

HAVING REGARD to Article 5 b) of the Convention on the Organisation for Economic Co-operation and Development of 14 December 1960;

HAVING REGARD to the Paris Convention of 29 July 1960 on Third Party Liability in the Field of Nuclear Energy, as amended by the Additional Protocol of 28 January 1964 and by the Protocol of 16 November 1982;

RECOMMENDS:

That any Contracting Party to the Paris Convention which, having had regard to the nature of the nuclear installation or nuclear substances in question and to the likely consequences of a nuclear incident involving them, establishes, by virtue of Article 7 b) ii) of the said Convention, the liability of certain nuclear operators at an amount lower than that established for nuclear operators generally, should take steps to make available public funds to satisfy any claim for compensation in excess of the lower amount so established, up to a total of the amount established for nuclear operators generally.
